For anyone wondering, the original campaign of Destiny 2 was literally deleted from the game and Bungie themselves can't even access it anymore lol

“Bungie archived the original code that comprised the ‘Red War’ and ‘Curse of Osiris’ campaigns (known as ‘legacy builds’),” game director Tyson Green’s declaration reads. “However, the ‘Red War’ and ‘Curse of Osiris’ legacy builds can no longer run because their outdated code is incompatible with Destiny 2’s underlying operational framework, which has evolved considerably since the ‘Red War’ and ‘Curse of Osiris’ campaigns were retired.”

“As a result, Bungie cannot feasibly provide the Court with the original Destiny 2 game as it existed in 2017, including the accused ‘Red War’ and ‘Curse of Osiris’ campaigns, in any operable or reviewable form. Nor will Bungie be able to produce the accused campaigns in operable or reviewable form if this matter proceeds to formal discovery.”

The judge emphasized that Destiny 2’s campaigns like Red War and Curse of Osiris are no longer available, and Bungie admitted there’s no way to play or review them in their original form. Because of that, the court couldn’t do the usual side-by-side comparison to determine if there’s actual copyright infringement. Bungie’s solution—fan-made videos—just wasn’t good enough.

The gunplay was nice before the controller update. There was a time when KBM players weren't punished simply for playing on the better system with better controls, so not only did Bungie nerf KBM by doubling and even tripling the kick on some guns, bloom is 25% larger and has a 12% growth per shot passively compared to controller, and controller was given an accent of higher aim assist (literal bullet magnetism, it's an in game stat that is modifiable) and cross hair magnetism.
There's before and after videos showcasing just how fucked over the KBM player base was. All the best players play controller now as a result.
Not only did they gut KBM, they buffed controller so console babies could get their fix of player retention marketing.

I'm going to disappoint you by saying I wasn't involved directly in that kind of higher level decision making. From what I could tell based on my own internal snooping, development of the game on a technical level was more or less good but the creative direction got completely upended about a year before release which I think is more or less public knowledge by now. There was definitely a "clear" direction of where management wanted it to go from a business perspective, i.e. Base game -> DLC 1 -> DLC 2 -> Expansion -> DLC 3 -> DLC 4 -> Sequel -> Repeat, but that shit fell apart after I think the third DLC pack to D1 when we realized it was unsustainable and we couldn't keep up.

I don't know if this counts as cool info, but from what I could tell we were not ready at all to take on the management of a live service game. There was an assumption that we could deploy the game, maybe do a small patch here and there between big releases, and that was it (sort of like Halo). We got a big reality check really fast and had to spin up a dedicated customer support team and a live service team, things you'd think we would have created beforehand. We were flying by the seat of our pants.

A model that was meant to generate a predictable revenue stream without having a subscription. Business people love predictability. Unfortunately when we realized that didn't work we sold our souls to the free to play and microtransaction model, something I vehemently spoke out about but could never make any difference on.

A combination of the entire story being thrown out a year before release and biting off more than we could chew. It's fortunate we even had something like the Vault of Glass on release, there were some who thought it was too much and too different (not me, I thought it was cool as fuck). In retrospect I think VoG practically saved the entire franchise by showing a hint of real unique potential.

Well the problem with that is what mention. There was this view like me and other Destiny 1 players saw that the game lack content. The DLCs that came out felt they should've been in base game and that's why people assume cut content happen at that time.

There was an assumption that we could deploy the game, maybe do a small patch here and there between big releases, and that was it (sort of like Halo).

This could have worked if they didn't go full fucking retard on the crucible. A lot of people were expecting halo 3 or reach's level of MP as far as game modes and that could have carried them hard like custom games did in Halo.

I think they were too stupid to figure out how to force specific loadouts so they couldn't do fun things like shotty snipers, rockets only, swords only, dodgeball sticky nade mode, etc. They finally managed to do something like that with team scorched in like 2019 but I assume that was all they were able to muster up in the creativity department. We were never going to get anything like grifball in destiny.

I can tell you for a fact the DLCs were not cut content, at least not in the sense of completed content that we intentionally removed to sell for more money. Hell, the entire character of Eris was rushed through creation in direct response to the negative feedback of D1 lacking content, originally I don't think The Dark Below would have had Eris at all.

It's been so long that I really don't remember, but it probably would have been similar to Halo in tone and scope. The reason it was changed was that it was felt like your character didn't have enough agency and was instead just being treated as a grunt to do tasks for more important people. They wanted you to feel like the important one so they wanted to design a story around that and there just was not enough time to do that.

I worked at another big company and chances are, the legal team and the development team aren't talking. Usually faggot niggers in legal just talk to the managers and CEOs who in turn only talk to other managers and CEOs and don't understand dick about how the development process works. Which results in such wildly inaccurate court claims and these billion dollar companies who should have every ability in the world to be as competent as possible end up getting reamed every time.

Also just to say, the original story of the game was never actually implemented. It's not like we had cut scenes and voice actors and missions already done and then decided to change all of it. The story was all still in design docs and such while the game at the time was more or less a sandbox of destinations, enemies, weapons, etc.

I could not fucking believe that all the hype for Destinys seamless blending of player worlds amounted to zones with a few dudes running into hallways fighting 10 enemies and talking to the NPC outside like... every MMO ever. Also the F2P launch was a mess that had no clear direction for progressing and I don't care about gear score and the PvP was even floatier but unbalanced Halo with shit netcode. I suppose the issue is that the key to case is weighing the similarities to the plaintiff's works against the content that's clearly different. Using a recording by a third-party the court can't be certain that just offscreen behind the player is a character reciting a full transcript of the plaintiff's book, and the guy recording just happened to walk past that. Or that a lore essayist puffed up some parts of the story as being more substantial than they actually were int he product, while glossing over derivative parts of the story.
It seems pretty silly by common sense, but The Court would like to see the product first hand, and Bungie at this point is only able to produce things like archived store page summaries or back of the base game's case. Which likely just list off some proper nouns and generic concepts that overlap with the alleged stolen work.

Destiny did have good lore, or at least at certain points.

D1Y1 had incomplete lore, but what it did have was well written and carried that "New Age Vision Quest" vibe despite being essentially random trading card blurbs.

Taken King had 10/10 lore that turned the setting into a cohesive unique world in addition to being well written.

Rise of Iron was the first big misstep, besides the being irrelevant filler, the warlord retcons directly contradicted everything written about Guardians previously, and even now don’t really make sense with the “present day” rules. But the lore was at least written competently.

D2Y1 was the first nadir. Everyone was now a Marvel quipper, several factions and characters were rewritten into their complete opposites and the story seemed to outright disdain the players for having enjoyed D1 or taking its own story seriously. Between that and the gameplay it nearly killed the game

Forsaken was so good it saved the game. Had good lore and made it okay for things to be serious again.

Shadowkeep was pure filler.

Beyond Light is a halfway point where we see a big change in the writers room and start seeing the cracks that will rip open in Lightfall. We start seeing huge retcons from the new writers about "The Dark Side of the Force isn't evil or sentient, despite the fact for years it literally told us it was evil"

Witch Queen this new writing direction that wants to literally replace the entire world built up since D1Y1 is in full force.

Lightfall shits the bed. At this point the last of the old writers have moved on to other jobs and been replaced by new hires who have no intention of continuing the story built up over the last 9 years in favor of their own OC’s. Marvel Quipping is back. The story is as nonsensical as D1Y1’s while being as badly written as D2Y1’s. More importantly the entire fundamentals of the setting like the main villain are thrown out and we are told to our faces none of it ever happened.

I'm glad someone is finally fucking suing these pieces of shit for selling an expansion as a MAIN TITLE, deleting it and then repackaging it and calling it something NEW

It is indeed more complicated than just syncing from source control, but it's not impossible to do. The source code for the game client and the back end services are in the same repository along with the game content. You would very likely need to use an older version of Visual Studio and maybe a handful of other utilities to get the game and services to compile correctly, and building all the content will take literal days when done from scratch and without a build farm to distribute the load, but again it is not impossible to do. Any sufficiently competent engineer could figure out how to get this done, it wouldn't be easy or fast but it is 100% feasible.

Oh also, the game services supported the concept of being deployed on a single workstation for local development and iteration, so no need for multiple beefy servers. A local test environment could very easily be stood up if necessary.

But that is not what they are being sued for. A sci-fi author is claiming the story of the original campaign was ripping off one of his works. Bungie screwing their customers over is another matter.

What they are saying about adapting the older content to the newer structure of the game is actually true. The game client and its systems has significantly evolved over the years and they wouldn't be able to import the old content without a ton of effort. It wouldn't be impossible technically speaking, but it would be very, very time intensive. Would be much easier relatively speaking to do this but for some reason they claim it's not feasible.

Is the footage complete? Is it representative? Who's the person who took the footage and what's their relationship to the plaintif and defendants. It CAN be used in a trial, but the defense gets to challenge it, introduce youtube videos of their own. That only happens in the full trial, not pretrial.

Doesn't matter. The expectation is that the people who own the shit be able to demonstrate what the fuck they have. If they're using someone else's shit, that someone else is subject to cross examination, and that means no throwing out the case early. It's full trial time.
