How do you win

Should be an open co-op PVP with three factions: Pirates, Guards and Merchants.
Aside from the main city, the map would be divided into zones that can be controlled either by Pirates or Guards.
Guards can only spawn in the main city and have to go through a bunch of training to get enough experience and gear to go fight Pirates. They can only attack Pirates.
Merchants can spawn in every zone controlled by Guards, including the main city. They are the only ones capable of doing most of the resource gathering and produce items for other players, but have poor defense skills.
Pirates have no main hub, but can choose to start in every zone controlled by pirates. They can attack everyone, including other pirates.

There is the typical experience and level system, and different classes for each faction.
However, sense of progression is different. Outside the main city, killed players drop all their loot, with no exceptions.
For Guards, levels (ranks) grant them access to better loot. They are the only ones that can't use certain items if their level is too low.
Merchants can only use low level weapons, but they can also use tools and craft loot to get gold. They are the ones supplying the Guards with most of their equipment, food, ship repairs, etc. But they are also able to collect crops, lumber, metal, etc, for other Merchants.
Pirates have no level requirements for items and can use every weapon.

Trade is encouraged, and different kind of truces are allowed. Merchants can pay players from the other factions for protection or peace. If both parties agree, a timer is set and both players can't attack each other for the duration.

This makes me so upset because it was done and done well. Pirates of the Caribbean Online was an amazing mmo back in the day, the only thing that it really lacked was in the graphics department. It kinda looked like shit at times.
Once you get used to it however it was amazing. Sailing from island to island, combat was quick and engaging, you really felt taken into that world. You can still play the fan remaster but it'll obviously never reach its old peaks.

One thing I notice about animals is that they don't tend to kill eachother in mortal combat so long as they are of the same species.

It can happen, but it's unusual. Generally they are not to the death-battles. So I can imagine it would be a pretty serious offence in the animal kingdom to kill a member of your species.

New video game genres will arise once new types of game controllers are invented. The unique controller of the Wii allowed for unique genres to be created that were previously impossible with regular controllers.
Or even games like rock band which simulated instruments with physical controllers.
The next genre of games will come with a novel controller design . This new controller will allow a specific playstyle previously impossible with a regular controller.
