Unlocked Adnroids can be rooted very easily. But I agree Android phones aren't doing enough either. The law doesn't have to literally be root access though, just something that guarantees at least installing any apps and accessing all or most of the file system (perhaps difficult to define). Maybe also allowing third party apps to have more control if the users allows it as well. For example in android you can't have a third party settings app because almost all the relevant system functions are not available to third parties.
