As some autistic person wrote on some forum a thousand years ago, there are services and products. If you sell software, even in digital form and delivered via download, it's considered a product, and the buyer has all the rights associated with it.
Software can be marketed as a service, however (imagine paying for a year to use Photoshop, for example). But you usually know when you're buying (Steam, Nintendo eshop, PSN, Epic Store, etc.) or licensing (Photoshop and other similar programs). That's why Steam was forced to start offering refunds, by the way. They lost a case in Australia where they tried to argue that they're not selling games, but since you click “buy” and receive software via download, it was recognized in court that Steam does sell products and they had to accept the harsh reality.
