You know how Death Note works really well in a Japanese setting because Japan has death penalty? Batman is kind of the opposite of that. Maybe 10% of Batman villains would dodge the chair, and that's optimistic. Most of them could not plea insanity successfully, and some (like Penguin or Bane) wouldn't even try. Granted they banned capital punishment in US for a decade during the Silver and Bronze ages so it made more sense during that time.
