I'm not that guy, I'm just a different retard, but I think that if Bungie doesn't make any money from Marathon that the case would be a lot harder. If Marathon released and made money, I think it would be a cut and dry slam dunk case for the artist. That's just me thinking logically about it but not knowing anything about how it actually works.

As it stands now, the art is only used in a ton of promotional material, but the game hasn't released so they haven't actually made money off the stolen art. There might still be a case there, but even if they were to win, I'd think the payday would be miniscule compared to what it could have been. That is, if they do not take Bungie's offer, whatever the offer ends up being. I hope Bugnie either pays them well or that the artist holds out for a good deal, because Marathon's literal entire identity is the art they stole. They're just gonna run textures through AI if the artist wont settle though. It's not a total and complete winning position for the artist, because the game still has 4 months to release.

The original artist is from the UK. Clearly took a lot of inspiration from Designer Republic. Which is undeniable. But the Marathon art designer doesn't just go for any inspiration here... it is flat out copy and paste theft. That's some pure armature hour shit.

I and many I've worked with, do not have a good opinion of most graphic designers/artists, they're usually lazy and unable to grasp that what they do is a blueprint for actual work to be done.

At my last workplace we'd get their designs and then build them (this is normal), but the retards would have us change shit after it was built.
The revisions are supposed to happen on their end and get finalized and approved, but they were sending us the first things they came up with and then changed their minds later.
we got management involved and had to explain to them that shit coming out of their department had to be final, but they just couldn't fucken grasp it and would officially propose re-works immediately after we'd released the things THEY DESIGNED.

I've had similar shit happen basically everywhere I've worked, thankfully I just do backend now.

Saying that feeding images into a neural network to make it "draw" a specific character or mimic an art style is theft is like saying that using reference when drawing is theft.

its a machine that turns pictures into a coordinates.
it maps all these coordinates onto a huge multidimensional graph, the graph represents "concepts" and how much like a concept something is.
so a picture might be 0.002342 "hotdog" and 0.23452 "large_breasts" etc. for every concept it's aware of.
image generation is the reversal of this process.

so when the AI outputs a watermark, it's not because it's copy pasting that watermark, it's that all it's training data of "scenic ocean view" had a watermark and it thinks pictures of scenic oceans are supposed to have that watermark.
even if not a single training image looks like the output.

what I'm getting at is it can create entirely new images that are distinct from any of it's training data, and it might contain a watermark purely because of the association it's created.
saying they just copy paste isn't accurate because they don't.
you can try this by getting it to generate in a specific artist's style, and then a different artist, and then both artists set to 50% strength and the result looks like a mix of both artists rather than a copy paste of both of the artists work in a collage.
