In a lot of countries end user agreement doesn't actually nullify your rights to your property. The only way I think they can do it is similar to how always online games require an internet connection to authenticate access to the game, however even then I don't think they can brick your console only refuse access to their servers. Big car companies require you use their proprietary hardware and software to make modifications to their ECU, and you can't sue them if you use some 3rd party shit that fucks up your ECU or engine. Some of them even lock a lot of basic maintenance stuff behind proprietary equipment and tools they only allow licensed dealerships to have access to. I forget the brand, but I do recall one doesn't even let you under the hood without a special key only the licensed dealerships are given access to.
