From interviews from the devs we know it was Kepler that offered to cast Andy Serkis and Charlie Cox for the game, who are primarily cinema and TV actors, because they know about the industry. Kepler announced they planned a series/film adaptation of E33 immediately, so it can be assumed they negotiated for film rights from Sandfall.
Based on actual reality the publisher likely negotiated for film rights. Because of the way Kepler handles their company that was probably why sandfall can keep the game IP.
The devs were pretty smart with outsourcing their work but it's retarded that some people are acting like the main devs did nothing just because they hired contract work.
