I can't tell what's on his foot or what he's covered in? Is he covered in blood or is it feces? Looks kind of reddish brown, so I thought maybe it was blood but how did that happen? Warning shot is a meme. Unless you can fire in the sea. Ground can have lots of shit bullets reflect from or shatter, becoming danger to everyone around. If "STOP OR I'LL SHOOT" doesn't make you think they'll shoot then warning shots won't register either.

Yes, enough for a person in a normal state of mind. Half of the people I see being shot on body cam seem to be so out of it that they don't seem to consciously acknowledge the gun.
It's a lost less paperwork to just kill them. Sort of like when chinks let someone bleed to death on the sidewalk because they don't want to deal with the bureaucracy of trying to help.

Even if warning shots were not a meme, a warning shot is basically proving that your gun is loaded. Police guns are always loaded if the magazine is inserted so there is no reason to fire a warning shot
