The boxes have only said that the upgrade is available separately because otherwise you'd be double dipping at a premium for a game you already own.
Why not include the game data on the Switch cartridge but you have to enter game code for the cartridge to start working and sync up with the console, if that makes any sense. And you can only use the game cartridge for that specific console.

The Xbox works the same as the PS5 without Internet. If you put in a One game without Internet it will play it, but if you have Internet it will download the compatibility patch.

I'm saying right off the cart, you just pop the game in the Switch 2 and you can use all the new features the old Switch can't. It's like Link's Awakening DX, you play it on the GBC and you get new features. Nothing needs to be downloaded. It makes sense for older Switch games to have the upgrade download for Switch 2 enhancements, though a simple patch would be fine to fix the common issues those games had running on the Switch. Having to download the Switch 2 version when basically all the MP4 carts are Switch 1 is pointless. Still the the Switch 2 carts are an improvement over the old ones which are twice the size and are read faster, so unfortunately this the only way to play the better version on the Switch 2, which is most likely a digital version that requires the game cart.

The Switch 2 cartridges are not the same as Switch 1 cartridges. Cyberpunk 2077 wouldn't fit on a Switch 1 cartridge.
