Nintendo's new EULA makes customers consent to never file class-action lawsuits against Nintendo.
It is all in "16. Dispute Resolution; Binding Arbitration; Class Action Waiver"
Nintendo's new EULA makes customers consent to never file class-action lawsuits against Nintendo
It's probably related to the joycon drift lawsuits?
Almost certainly. They are future proofing themselves for inevitable subpar quality of Switch 2 joycons.
Well what if I do?
will they take my bing bing wahoo and toddlerslop games away?
Why would you sue the good guys of the gaming industry?
I knew I'd be justified in not pre-ordering a Switch 2 purely because I knew Joycon drift was going to keep being a fucking thing
Good thing I'm not a customer lmao. Nintendrönes gets what they deserve
The only ones benefitting from class-actions are the lawyers.
EULAs attempting to overrule the actual legal system
Much like Adolf, Luigi did nothing wrong.
This shit never going to work. It didn't work for Disney it won't work for Nintendo.
vicksburgnews.com
kek I immediately thought of this case too. Imagine the same situation happening at NintendoWorld and the person isn't allowed to sue because they're a NSO member.
see
it's already standard precedent that EULAs don't hold a damn worth of value.
Sorry but your EULA isnt above my rights
Why would you sue the good guys of the gaming industry?
No, but you can check names on LinkedIn against the Redmont Washington directory listings and go make their lives real fucking interesting.
This EULA thing of "you can't lawsuit us" never works.
There's plenty of cases where it ended up being thrown in the trash when someone wanted to sue a company.
The actual issue comes from being one guy against a multi-billion dollar value company that has more lawyers than you have people you can name.
That reads more like nintendo wants issues handled privately rather than huge public disputes. You can still do arbitrations.
MAN SUES DISNEY OVER DISNEYLAND KILLING HIS WIFE, SUIT THROWN OUT DUE TO WAIVER IN EULA
WTF THIS IS AN OUTRAGE!!! KILL DISNEY RIGHT NOW
GAMERS SUE NINTENDO OVER POOR QUALITY OF THEIR PRODUCTS, SUIT THROWN OUT DUE TO WAIVER IN EULA
shouldn't have thrown your joysticks against the wall :) why are you playing children's games anyway, aren't you adults lol?
lazy judge gives corporation the win knowing he's in no danger and signs off
And that's why it worked then, but it won't work now.
I recall that there was also one case where Lyft tried to stop victims of a Lyft car crash (victims were not in the Lyft car) from suing them because daughter of the victims who lived at home had used Lyft and therefore agreed to EULA, and the Lyft lawyers tried to argue that it applies to entire household. No idea how that case went.
PS5

DA POWER OF DLSS
this is never going to hold up in court
Dystopian as fuck
Like that Disney EULA that you can't sue Disney if someone die in their parks if you own Disney +
Tendies will defend this.
shitload of kino games
Two games*
People said the same thing about the Palworld lawsuit.
Yeah, Japan has a different legal system? We're talking about the US legal system.
Yeah, if anyone ever complained about corporation bias of US legal system, it is infinitely worse in Japan. In Japan corporations can sue you (and win) just for tinkering and file modification of devices you own.
yeah it sucks. Lemon laws would apply if something like the Joycon class action happened again. This won't protect them.
The EU might have it's flaws, but at least Corpos here don't have that much power.
In Europe we still can.
Court documents show that the company is trying to get the $50,000 lawsuit tossed because the plaintiff, Jeffrey Piccolo, signed up for a one-month trial of the streaming service Disney Plus in 2019, which requires trial users to arbitrate all disputes with the company.
Thanks Doc
shoop bowsers face over mattrick
it worked then
It didn't work then, the lawsuit against Disney wasn't dismissed.
I am actually more concerned about the reminder of said Eula changes.
The Eula changes were enforced since yesterday May 7th, right? I got an Email only two minutes ago. Aren't there Laws that dictates that Companies or other forms of contracts have to notifiy their consumers of changes in a Eula pre-emptively?
What the fuck is happening there?
Eula changes notification arrived a day later
Is that even legal to delay notifying your users for contractual obligations?
>Switch 2
450$
Who's gonna tell him?
The switch 2 is equivalent to a ps4 which is a 12 year old console, it's not running anything at 4k 60 fps
Sounds like they're scared of someone rightfully suing them for shit like this.
Nintendo: Switch can run at 4K 60 fps
Random tranny: NOOOOOOOOO IT ACTUALLY CAN'T!!!
i dont get how in 2025 something like eula can be legally binding without propah physical signature.
shitload of kino games
"my first Nintendo console was a Switch"
To be a Nintendo fan you have to be a bitchless cuck that takes up the ass?
Contracts are a very standard part of the legal system.
This kind of cult worship to the point of outright lying to defend them is a big reason why Nintendo just fucks you people.
Where's the lie?
This wouldn't hold up in a non corrupt court, obviously.
I could put rat poison in Soda and then sell it with a EULA that your family can't sue me if you die by consumption
It's beyond retarded
Was pretty sure all companies already did this, but *slurp slurp slurp*
consolekek tech illiteracy
It's too hard to find the first GPU to output 8k, but even the Geforce GT 1030 could output 8k 60. That doesn't mean you'll ever be gaming at that resolution.
confirmed to be comparable to PS4
No, it beats the PS5 pro and everything.
You do it for free, and you don't even get to suck Nintencock.
Nintendo's heavily leaning into DLSS this gen. Enjoy your fake frames.
